1. Introduction and Acceptance
Welcome to Konsiguelo. By downloading, accessing, or using our platform, you agree to be bound by these Terms and Conditions. If you do not agree with any part of these terms, you must not use our services. Konsiguelo acts solely as a hyperlocal digital directory connecting users with local businesses and service providers.
2. Eligibility and Account Registration
To use Konsiguelo as a general user, you must be at least 13 years old. To register a Business Account, you must be at least 18 years old and have the legal authority to represent the business. You agree to provide accurate, current, and complete information during registration and keep your profile updated. We reserve the right to suspend or terminate accounts that contain false, misleading, or unauthorized information.
3. Description of Service and Transactions
Konsiguelo provides a platform for businesses to display their products and services. We do NOT act as a payment gateway, broker, or intermediary in the actual transactions between buyers and sellers. All purchases, agreements, and communications (via WhatsApp, phone, or in-person) are strictly between the user and the business. Konsiguelo does not guarantee the quality, safety, legality, or existence of the items advertised and assumes no liability for any disputes, losses, or damages arising from such transactions.
4. User-Generated Content (UGC) and Moderation
We maintain a zero-tolerance policy for objectionable content. Businesses and users may not post content that is illegal, offensive, pornographic, violent, infringes on third-party intellectual property, or promotes the sale of restricted goods (e.g., weapons, drugs). Konsiguelo employs both automated filters (whitelists/blacklists) and manual administrative reviews to monitor content. We reserve the right to immediately remove any content or suspend any account that violates these guidelines without prior notice.
5. Reporting Abuses and Objectionable Content
To ensure a safe environment, Konsiguelo provides in-app features for users to flag and report inappropriate businesses, products, or reviews. Our moderation team reviews all reports promptly. If you encounter content that violates our policies, please use the 'Report' button available on the business or product profile. We will take appropriate action, which may include permanent removal of the content and the offending user.
6. In-App Purchases and Business Packages
While the core platform is free, Konsiguelo offers premium features, such as product expansion packages for businesses, which can be purchased through Google Play or Apple App Store. These In-App Purchases are subject to the payment terms, conditions, and refund policies of the respective app stores. Konsiguelo does not directly process these payments and cannot issue refunds for purchases made through third-party stores.
7. Intellectual Property Rights
All original content, features, and functionality of the Konsiguelo app—including but not limited to its design, code, text, graphics, logos, and interfaces—are the exclusive property of Konsiguelo and are protected by international copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or reverse-engineer any part of our application without our express written consent.
8. Disclaimer of Warranties and Limitation of Liability
The app is provided on an 'AS IS' and 'AS AVAILABLE' basis. Konsiguelo makes no warranties, expressed or implied, regarding the app's availability, accuracy, or reliability. In no event shall Konsiguelo, its directors, employees, or agents be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or goodwill, arising out of your use of the platform.
9. Governing Law and Jurisdiction
These Terms and Conditions shall be governed by and construed in accordance with the laws of the United States, without regard to its conflict of law provisions. Any legal action or proceeding arising out of or relating to these terms shall be brought exclusively in the applicable federal or state courts of the United States.
10. Changes to Terms
We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect. By continuing to access or use our Service after those revisions become effective, you agree to be bound by the revised terms.
